INTRODUCTION
The Promotion of Access to Information Act, 2 of 2000 (the “Act”), gives effect to Section 32(1)(a) & (b) of the Constitution of the Republic of South Africa, which provides for the right of access to information held by public and private bodies when such information is requested for the exercise or protection of rights.
The Act sets out the requisite procedures for requests, requirements to be met, and grounds for refusal.
The right to information may be limited to protect privacy, commercial confidentiality, and good governance, where such limitations are reasonable and justifiable in an open and democratic society.
This Manual is prepared to inform requesters of the procedures and requirements for accessing information held by Charter Academy (Pty) Ltd.

PART VI: PROCEDURE FOR REQUESTS
Requests for information must:
- Be made on the prescribed Form C (see Appendix 1).
- Include sufficient detail to identify the record.
- Be submitted with the prescribed fee (if applicable).
- Be sent to the Information Officer at the addresses provided.
Timelines:
- A response will be given within 30 days.
- This may be extended by a further 30 days if a large volume of records is requested or consultations are required.
OUTCOME OF REQUESTS
- If granted, the requester will be advised of any access fee payable and the form of access.
- If refused, reasons will be provided, along with the applicable provisions of the Act and remedies available.
GROUNDS FOR REFUSAL
Access may be refused if it involves:
- Unreasonable disclosure of personal information of third parties.
- Commercially sensitive information.
- Breach of confidentiality agreements.
- Endangerment of individuals or property.
- Privileged legal documents.
- Intellectual property, including proprietary training content or software.
REMEDIES
Charter Academy does not have internal appeals. Dissatisfied requesters may apply directly to the High Court or relevant Magistrate’s Court within 30 days.
FEES
The prescribed fees for PAIA requests are available on the SAHRC website under the “Access to Information/PAIA” section.
